It all stemmed from the fact that in 2016, when he wasn’t even an adult, he had been caught by the police during a check inside his school in possession of “a cigarette containing tobacco and hashish weighing a total of 1.5 grams” . An affair that he thought was over but which closed the doors of the tender to him. So he took legal action, highlighting that that was the only fact that could be blamed on him, which also occurred when he was a minor and with a negligible quantity of drugs. The young man, through his lawyers, among other things highlights that the legislation on this issue was only subsequently modified and that in any case there would be no proportionality of the measure, “since a single episode occurred in a moment of fragility of the then minor would preclude his subsequent life and professional path.”
Objections which, in a detailed sentence, first the Lazio TAR and then the council of state are not accepted: the administrative judges, in particular, highlight how it was a precondition on the part of the financial police to ascertain “the irreproachability of the behavior of the candidate in relation to the functions of the rank to be held” and that among the items envisaged there is, in fact, driving while intoxicated and the use or possession of drugs.
