Waste management in the city, Brodolini’s appeal ok

The Regional Administrative Court’s blow comes to the tender for the collection and transport of urban waste. The administrative court, with a sentence filed the day before yesterday, in fact annulled the awarding of the service by Hera to Teknoservice. The TAR’s ruling comes in acceptance of the appeal presented last autumn by the Brodolini cooperative, which ranked second together with Ciclat Trasporti Ambiente. Right from the start – it was November – the runners-up had turned to the judiciary to obtain a stop to their custody. The managers of the Brodolini cooperative had challenged the act, deducing its illegitimacy in various respects and requesting its annulment. The other day, it was said, the judges essentially agreed with Brodolini.

At the center of the tug-of-war before the administrative judge was the Hera provision through which the award of the restricted procedure for the assignment of services connected to the urban waste collection and transport service was arranged in favor of the Teknoservice company. and similar to urban ones, of sweeping and ancillary services in the territory of the Municipality of Ferrara for a period of 24 months. Through a long and detailed ruling, the judges of the second section of the Emilia-Romagna TAR accepted the appeal presented by Brodolini, both the main one and the additional reasons. With this decision, the judges therefore annulled the award. At the moment there is no comment from the Brodolini coop, which simply takes note of the verdict and awaits the next steps. In the abstract, this should imply a shift in the ranking in favor of Brodolini. But it is still early to draw conclusions. In fact, an appeal to the Council of State by the ‘defeated’ is probably looming. The matter may therefore not yet be definitively closed.
