The Ordinary Court of Pisa accepts the appeal of the B&Z firm, recognizing the appellant’s right to assume the role according to the former article 59 starting from the date of the unjust exclusion.

The Court of Pisa firmly condemned the school administration, accepting an appeal supported by the lawyers Bongarzone and Zinzi of ricorsiscuola.it. This law firm, with over hundreds of successful appeals, is a national point of reference for teachers qualified abroad awaiting recognition of their qualification. The ruling provides the appellant’s full right to be hired starting from the 2021/2022 school year, when she was excluded from the recruitment procedure.

The ruling confirms the full validity of teaching qualification courses obtained abroad, which also give access to permanent contracts. The applicant, specialized in the ADSS competition class and graduated in Romania, had been excluded from the recruitment procedure by decision of the school administration.

Although she was included in the GPS of the province of Pisa with reservations, the teacher should have been considered within the recruitment procedure reserved for teachers with a qualification of specialization in support, regulated by Art 59.

However, on the orders of the regional school office of Tuscany, the teacher was excluded from the recruitment procedure in favor of other less qualified candidates. This provision significantly compromised the career of the teacher, who turned to the B&Z law firm of ricorsiscuola.it to challenge the decision and assert her rights.

The proposed legal action fully protected the rights accrued by the teacher, so much so that the sentence issued by the Court of Pisa defined the teacher’s right to be hired starting from the 2021/2022 school year.

  • The qualification abroad is to be considered fully valid, at least until the last level of judgment on merit.
  • The responsibility for evaluating a qualification is exclusively reserved to the MIM (formerly MIUR) and not delegated to the USR as happened in this case.
