TERNI – A ninety-year-old from Terni fell from the stretcher in the emergency room of the hospitalwhere she had arrived with the 118 ambulance following an illness.

After the accident, which caused her to fracture her humerus, thehospital company compensated the family members of the elderly woman, who later died from other causes, and now the accounting magistracy has presented the bill to those allegedly responsible for the fall of the ninety-year-old.

The accounting prosecutor’s office summoned three people to trial, with a document filed on 18 August 2023: two nurses and a medical director and now, eleven years after the accident, the sentence has arrived.

There Umbria Court of Auditors sentenced a nurseat the time serving in the emergency room of the “Santa Maria”, to compensate with almost 12 thousand euros for the Terni hospital.

The requests for conviction of the other nurse and the medical director were rejected from whom the prosecutor had asked for compensation of almost 12 thousand euros each.

The accident dates back toFebruary 8, 2013when the woman fell from the stretcher, with the containment sides raised, on which she had been positioned upon her arrival at the emergency room.

In the fall he reported the fracture of the humerus left.

A few days after the accident, the elderly woman made a request for compensation for damages against the Terni hospital and a few months later the civil trial began in front of the Terni court which closed in 2016, with a final sentence , condemning the hospital to pay damages to the heir of the ninety-year-old, who has since died. Almost 36 thousand euros paid by the insurance to the family members and reimbursed by the Santa Maria company.

For the accident, the accounting prosecutor’s office asked the two nurses and the medical director to pay the bill and now comes the sentence of conviction for the nurse alone with the two colleagues for whom it felt it was not necessary to proceed.

For the Court of Auditors «there are clear violations of the duties of care and supervision of the patient by the nurse, taking into account that, according to her own testimony in the civil trial, the elderly woman had told her that she wanted to get off the stretcher after more than for four hours she was unable to move, but despite having heard the call and seeing the dangerous maneuver of sliding off the bottom that the lady was starting with her feet, she was unable to intervene in time to stop her before she fractured the humerus of her arm left”.

The appeal was discounted.
