PESARO – He had killed the family dog, cared for by his wife without any apparent reason and for this the man had been reported. But the psychiatric report deems him incapable of understanding and will. The incident dates back to last November when a 62-year-old resident of Pesaro, “out of cruelty and without necessity” while he was at home, suddenly took a kitchen knife and began to launch a series of blows against the black cocker, a small size, who died shortly afterwards.

All of this, in fact, for no apparent reason, but with an aggression triggered by a fit. At that moment the man was alone at home and his wife, who usually took care of the dog, had gone out. She then took the cocker’s body and threw it in the garbage bin near her house. Upon returning, his wife had immediately understood, also from the psychologically altered state of the man, that something was wrong. Then, having noticed the disappearance of the cocker, she had asked where their dog had ended up and what had happened shortly before emerged: killed and thrown away .

Hence the call to the police and 118 who had to transport the man, in increasingly difficult mental conditions, to the hospital where it was necessary to subject him to compulsory medical treatment. But at the same time the official complaint was filed against the man who would have had to answer for the crime of killing animals. In practice, anyone who, through cruelty or unnecessarily, causes the death of an animal is punished with imprisonment from four months to two years.

The 62-year-old, defended by the lawyer Liana Pesaresi, was subjected to a psychiatric evaluation through an evidentiary incident before the investigating judge. According to the psychiatrist, the suspect has no legal capacity and if he follows the treatment he is not socially dangerous. The wife, the official owner of the dog, appears to be an offended person and is followed by the lawyer Alfredo Torsani and Anna Bartoli. The file returns to the prosecutor’s office for further determinations by the prosecutor.
