The death dates back to October 2018: the person who lost his life was a 78-year-old man from Terni who, admitted to the Terni hospital following some heart problems that required surgery, had contracted a staphylococcal infection which in within a few days it had led to his death.

In this matter, the man’s family members, after several out-of-court attempts to obtain compensation for the death of their relative, have filed a civil lawsuit against the ‘Santa Maria’ hospital in Terni, which has always declined any responsibility in the matter. to what happened.

Proceedings which concluded, as far as the first degree of judgment is concerned, on 11 June with the sentence issued by the court of Terni, through the civil judge Claudia Tordo Caprioli. The sentence saw the hospital company ordered to compensate the two sons of the 78-year-old, assisted by the lawyer Roberto Romani of the Terni bar, for a total amount exceeding 300 thousand euros and including both pecuniary and non-pecuniary damages. At the same time the ‘Santa Maria’ was also sentenced to pay the costs.

«The case – states the lawyer Romani – focused attention on the non-compliance criticized by the appellants, which consisted in an error of the hospital structure due to an organizational defect, and in an error attributable to the healthcare personnel of the hospital due to the late diagnosis of sepsis despite the presence of evident clinical signs in the immediate post-operative phase and then for having administered an inadequate antibiotic treatment”.

The staphylococcal infection, presumably contracted during surgery, had precipitated a clinical picture marked by other pathologies, leading the 78-year-old from Terni to his death within about ten days. In light of the sentence, it is plausible that the Terni hospital will appeal to have its point of view recognized and, therefore, the reasons supported.
