Another “no” from the Municipality to the antennas: legal opposition to the appeal of the management company’s plan has begun. Last week, the Municipality of Bagni di Lucca was notified of the appeal to the TAR presented by the company Iniwit Spa against the Municipality itself, the District Basin Authority of the Northern Apennines, the Tuscany Region and the Union of Municipalities of the Valle del Serchio. The appeal concerns the annulment of the managerial decision of the technical area with which the Municipality of Bagni di Lucca, on 5 April 2024, definitively rejected the request presented by Iniwit and Tim spa for the creation of a 5G antenna in Cappella in San Cassiano di Controni.
The appeal also contains the request for the granting of the precautionary measure aimed, pending the proceedings, at allowing the appellant companies to be able to continue the installation project on a precautionary basis in order to avoid the economic damage that would result from the failure to carry out the work and the consequent loss of expected PNRR contributions. The Municipality of Bagni di Lucca, given the urgency and importance of the issue, promptly entrusted the task of a lawyer expert in the matter who will follow the reasons and interests of the Municipality in this important legal matter. Given the urgency of the issues discussed, the precautionary hearing was set by the Florence Regional Administrative Court for 12 June. Updates will follow and will be promptly brought to the attention of citizens.
