The new union ordinance on the so-called Movida in the city of Mazara del Vallo has been in force since May 31st and for the entire year 2024. “Having taken note of the results of the meeting of the Provincial Committee for Public Order and Safety on 7 May 2024 – we read in the ordinance – it was agreed on the need to adopt uniform trade union ordinances which include, in addition to aspects of urban safety, also the regulation of emissions sound in public establishments, public places and entertainment venues and last but not least uniformity within the limits of musical entertainment times”.

In particular, regarding the sale of alcoholic beverages the ordinance provides for the following requirements: throughout the municipal territory, from 10 pm every day until 6 am the following day, the sale and administration – both in fixed and itinerant form, as well as the possession and consumption in public places of alcoholic and spirit drinks is prohibited, even if dispensed from automatic dispensers. Furthermore, the sale of alcoholic and non-alcoholic drinks in glass bottles and containers and cans by public establishments, commercial establishments, artisanal take-away establishments, automatic dispensers and Street Food. The prohibitions do not apply within public premises and spaces legitimately occupied by authorized public administration establishments. The traders to whom the ban on the sale of alcoholic and spirit drinks, the subject of this act, extends are the following: a) activities of supplying food and drinks, even on a temporary basis; b) private clubs; c) artisanal activities; d) commercial activities; e) vending machines;

Regarding noise emissions: without prejudice to compliance with the noise limits, both absolute and differential, established by current national and local regulations, the diffusion of music inside and outside public establishments for the administration of food and drinks of type a) and b) referred to in art. 5 paragraph I of Law 25 August 1991, n. 287, both live and reproduced, is subject to the following time limits. On the days of each week from Sunday to Thursday, including holidays and pre-holidays, noise emissions must cease without delay at 0.30 am of the following day, and produced, in any case, in compliance with the absolute and differential limit values ​​established by law; on Fridays and Saturdays of each week the noise emissions must cease without delay at 1.30 am the following day.

In the week of August, from Monday 12th to Sunday 18th, noise emissions must stop without delay at 2am the following day. Without prejudice to what is established in the preceding points, any type of musical diffusion both outdoors and indoors, by any means, on any day of the week between 01.00 and 07.00 is prohibited throughout the municipal territory. .00 and in the time slot between 2.00 pm and 4.00 pm each day.

In all cases, the performance of musical activities is subject to the fulfillment of the obligation to present the acoustic impact documentation required by article 8, paragraphs 2, 3, 4 and 5 of law no. 26 October 1995. 447 and, where necessary, by the subsequent paragraph 6 of the Framework Law on noise pollution, as integrated by article 4, paragraph 1, of Presidential Decree no. 227 of 19 October 2011.

Compliance with the regulations on noise pollution and observance of the sound emission limits, both absolute and differential, provided for by the regulations in force on the subject, constitute a condition for the legitimate exercise of musical activities, both inside and outside the public establishments. Compliance with these acoustic limits must be certified by a phonometric report, pursuant to Law 447/95 and Prime Ministerial Decree 04/16/1999 n.215.

The requests for authorization for the demonstrations and events with music broadcast they must reach the SUAP of the City of Mazara del Vallo by certified email to the address “[email protected]” no later than 11 am on the third day before the demonstration or event with music broadcast or the use of musical instruments. All requests received late or in an unconventional manner will not be taken into consideration. If from the requests received there are requests for the same evening and for demonstrations and/or musical events organized in public establishments that are less than 90 meters away from each other, the same will be authorized in compliance with the chronological order of arrival and also published on the institutional website of the Municipality, also for the purposes of subsequent control and monitoring activities carried out by the Police Force.

Business owners holding authorizations for the occupation of public land are required to maintain the decorum of the public space granted to them and/or the surrounding areas as foreseen and identified in the public land concession deed, making them constantly free from waste, cans, bottles and clutter of any kind.
