The doctors had given a negative opinion, but the parents had chosen a home birth to give birth to their daughter. However, the little girl, born in September 2017 with a breech birth in a house in Trento, had suffered neonatal asphyxia and permanent damage at the time of birth. For this reason the mother and father risk condemnation, together with the two midwives who were present at the time of labour.

The negative opinion of doctors

The pm Alessandra Liverani accused them of causing very serious, “incurable” negligent injuries linked to the behavior of the parents and the two midwives. According to the Prosecutor’s Office, “they were aware of the baby’s breech position, aware that this could lead to adverse events with serious consequences, and in fact the Santa Chiara doctors had told them to go to the hospital in labor for the cesarean section”

The prosecutor’s request

Hence the request for a sentence of three months for each parent respectively, and six and nine months of imprisonment for the two professionals made to the judge Greta Mancini. One of the two midwives was also accused of the crime of forgery of a public document: again according to the accusations she had modified the obstetric record, with the aim of attenuating her position and that of her colleague by postponing the salient phases of the birth. The civil party has asked for one million euros, waiting for the damages of the girl who is now 7 years old to be quantified.
