TRECASTELLI The blade of the trimming machine had injured three fingers on his left hand. The thumb had suffered amputation, so much so that the worker had a permanent impairment of his prehensile function. For that accident, which occurred in the Valli Zabban laboratory in Trecastelli on 25 March 2021, three of them ended up process: the CEO of the company, the director of the plant and the production manager of the sector where the worker worked at the time. Yesterday morning the sentence arrived: judge Pietro Renna sentenced each of the defendants to serve eight months imprisonment, suspended sentence.

The accusation

They had to answer for negligent injury in competition. The worker, a civil party with the lawyer Domenico Liso, will receive a total compensation of 105 thousand euros. Yesterday, the 33-year-old from Senigallia was present at the reading of the sentence. He still works within the company, but has changed his job: he is a forklift driver. In a previous hearing, he had recounted what happened on that dramatic afternoon, which ended with a rush to the hospital to try to save the fingers of his left hand, which ended up under the blade of the trimmer.

The story

The worker recalled in court that he had started working with that machine “about three months ago” and that “I never had instructions on how to operate”. And again: “there were no protections on the circular saw and along the cutting section.” The machine was used to cut rubber agglomerate sheaths. Valli Zabban, in fact, is a company specialized in the production of bituminous membranes. «To use that machinery I had no specific training, I did not follow a course and I was never invited to read the user manual. What happened on the day of the accident? The blade of the trimming machine severed the thumb of my left hand.” Two other fingers were damaged. The accident led INAIL to award the worker a monthly compensation of 265 euros.

The decree

Initially, a criminal decree of conviction was sent to the three defendants: it was appealed, which then led to a trial. The prosecutor’s office contested in various ways the worker’s introduction to work “without adequate professional training” and the lack of “adequate protection systems”. All accusations rejected by those directly involved, through their defenders. There would have been no omissions or irregularities regarding the protection of employees. So much so that it is likely that the trial will reach the second level of judgement.
