The Court of Castrovillari, in full acceptance of the requests made by the criminal lawyer Francesco Nicoletti, acquitted a young woman of charges of private violence and threats with the broadest formula: because the facts do not exist.

The accused had been reported by her ex-husband who, turning to the police, after declaring that he had left home and had started the process of separating from the woman he had married and with whom he had had a child, reported in detail the episodes that were then the subject of criminal proceedings.

Specifically, on one occasion, while he was inside a club with his new girlfriend and some friends, the accused parked her car in front of the club and, filming the scene with her cell phone, insistently rang the horn to attract attention. The man, in inviting her to leave, received insults and threats. Not only. Once he got into his car, the woman prevented him from making any maneuvers by blocking him with her car and then got out, approached him and addressed further insults and threats. According to the man’s story, there would subsequently have been a real chase by his ex-wife, with ramming attempts, which ended under her house.

The woman was then brought to trial to answer for the alleged crimes. During the preliminary investigation, the man confirmed what he had reported to the police, just as the witnesses he indicated, i.e. the friends and new girlfriend present on that occasion, had also confirmed the facts. Finally, a witness indicated by the defense was examined.

At the end of the council chamber, the Court of Castrovillari, in total acceptance of the requests made by the lawyer. Francesco Nicoletti, acquitted the young woman of the crimes of private violence and threats with the broader formula “because the fact does not exist”.
