Despite the deadline on 3 December 2020, Soget, the company concessionaire of the collection service for unpaid tax fines on behalf of the Municipality of Salerno, would have continued to collect sums and notify administrative stops, for over two years and five months until the Municipality of Salerno has signed a new agreement with MUNICIPIA SpA entrusting it with the service. This was denounced this morning by the representatives of Forza Italia in a conference in which they presented the complaint of the active citizenship movement. As stated in the complaint, “the concessionaire company SO.GETSpA, even though the contract had expired and without any extension, in the absence of a suitable title relating to the legitimacy to collect, continued to notify documents to the citizens of Salerno as well as to promote enforcement actions – including administrative seizures of registered movable property and seizures by third parties, thus carrying out a public service of notification, collection and enforcement for which it could not retain any power, not even in court and, therefore, with a total absence of both substantial and procedural tax legitimacy, also with regard to disputes arising following opposition to the documents by the recipients of the measures issued”. According to Roberto Celano, group leader of Forza Italia and Giuseppe Fauceglia, citizen coordinator of the party, there are the conditions for opening a class action by citizens affected by the measure. The lawyer Leonardo Gallo, who also signed the civic movement’s complaint, will take care of it. The failure to notify the Ministry of Finance of the holiday period prevented the appointment of the Government Commissioner who would have guaranteed both the collection of management residues and the interruption of the limitation periods and effectively determined the nullity of the assessment notices relating to sanctions to the CD. Highway Code, ICI and IMU notified by SO.GETSpA from 3 December 2020 to October 2023. The sums unjustly collected would vitiate both the forecast and final budgets of the Municipality of Salerno in which said sums were included. ,Forza Italia invited the Municipality of Salerno to proceed with the cancellation in self-defense to avoid appeals, but also to identify who is responsible. “It is a city in disarray where the rules are considered accessory, but the lack of organizational structures can be remedied with greater attention – said Fauceglia, justifying Forza Italia’s action not as an attack but as an intervention to help the Municipality – we care about this city, we don’t want to destroy it.”
