Through a note signed by the Deputy Prosecutor Silvio Marco Guarriello, sent to the Prosecutor of the Republic of Foggia and to the Deputy Prosecutor, the Prosecutor’s Office of Foggia denies news relating to the fall of the circumstantial gravity relating to the well-known “Hands off” operation, with 7 precautionary measures carried out on 9 March 2024 by financiers of the Manfredonia Company against as many suspects, including some public officials currently or in the past serving at the Siponto Municipality and the Ase, for the crimes of extortion, extortion and corruption, embezzlement, forgery, personal injury, threats and private violence.
Yesterday, March 27, StatoQuotidiano.it had correctly published news relating to the provisions of the Court of Review and Prevention Measures of Bari regarding the position of some suspects, without adding analyzes or reflections on the existence of the facts, pending the relevant proceedings criminal.
“In the last few hours, local press outlets have provided news about the outcomes of the procedures before the Review Court with reference to the investigation referred to in the criminal proceedings which concerns events committed in Manfredonia and which also involve the management of the municipal public administration“, writes Prosecutor Garriello.
“The information provided misleadingly emphasized these decisions, proposing them as a denial of the prosecution system”.
From here, “a specific public interest in correct knowledge of procedural events (as in fact published by StatoQuotidiano.it, ed.) relating to a complex and relevant investigation which received wide coverage in the media”.
As part of the criminal proceedings of 27.3.2024, the Review Court ruled on the requests for review proposed by Michele Antonio Romito, Grazia Romito, Luigi Rotolo, Michele Fatone, Raffaele Fatonehe thus decided:
-For Michele Antonio Romito confirmed the existence of the circumstantial gravity and precautionary needs, limiting itself to replacing the precautionary measure of prison with another precautionary measure of a custodial type (house arrest);
-For Grazia Romito And Luigi Rotolo has “carried out the legal requalification of the fact contested by them – to be considered, therefore, confirmed in the circumstantial gravity – from ideological falsehood committed in a public act (48-110-479 criminal code) to ideological falsehood committed in administrative authorization (48-110-480) , ordering the release of the suspects since the crime title, as reclassified, does not allow the application of the coercive precautionary measure”.
-For Raffaele Fatone the request for review proposed against the gravity, circumstantial and precautionary needs was rejected, therefore the application of house arrest continued; for Michele Fatone the precautionary measure of custody in prison was confirmed, even if the request for review was partially accepted limited to only two of the ten charges against him, the weight of circumstantial evidence for the other eight remaining unchanged”.
The suspect Angelo Salvemini did not propose a re-examination.
“The reasons of the Review Court will be filed within 45 days and the Prosecutor’s Office reserves the right to evaluate any appeal to the Court of Cassation, waiting to read the reasons for the decision, the accusatory system can be considered largely confirmed”.
“It should be highlighted that the persons subjected to investigations cannot be considered responsible for any crime until a definitive conviction has been pronounced against them”.
For Michele Fatoneborn in 1961, e Raffaele Fatoneborn in 1992, already recipients of the precautionary measure in prison (the first) and under house arrest (the second): following the outcome of the Review, Michele Fatone remains in prison, while no request for the Review had been presented for Raffaele, for whom he remains therefore the precautionary measure of house arrest remains unchanged.
Updates are awaited for the position of the former city secretary pro tempore Galantino Giuliana Mariaborn in 1959, recipient of the ban from public offices or services for 12 months.
