A 39-year-old driver got behind the wheel despite being intoxicated and was reported by the local police of Modena following a road accident that occurred along the Modena-Sassuolo ring road, shortly after 1.30 am on the night between Thursday 27th and Friday 28th June. At the time of the investigations, the driver had an alcohol level almost three times the legal limit and a woman was slightly injured in the incident.

As reconstructed by the accident report, the accident occurred along the Modena-Sassuolo ring road, shortly before the exit for Baggiovara. The 39-year-old, resident in the province, was traveling along the ring road, towards Sassuolo, driving a small truck, when he collided with a car, Kia model, driven in the same direction by a 65-year-old, also resident in the province; Also in the car was a 59-year-old, owner of the vehicle.

The patrols of the Via Galilei Command intervened on the spot, starting the investigations aimed at determining the causes of the incident, including the breathalyzer administered to the drivers. The woman, who tested negative, was subsequently accompanied to the emergency room of Baggiovara having suffered minor injuries.

The examination revealed the 39-year-old’s state of alteration, with a blood alcohol level almost three times above the permitted level (the limit is 0.5), placing him in the second band identified by the regulations. The man was therefore charged with the crime of drunk driving defined by article 186 of the Highway Code, which led to the withdrawal of his license, while the car, owned by the company he works for, was not affected by any measures.

The judicial authority will now decide to what extent to apply the possible criminal sanction against him (the fine ranges from 800 to 3,200 euros) and the accessory charges, including the deduction of points and the duration of the suspension of the driving license from six months to one year. The sanction may also be increased by a third to a half, since the facts were committed during the night hours (after 10 pm and before 7 am).
