The mechanism would have been implemented by assigning to such specific personnel treatment equal to that of holders of simple level III managerial positions (80% of the position salary of the General Secretary). According to the Accounting Prosecutor’s Office, this would also have occurred in full violation of the obligation to appeal to the national contract for the purposes of concrete determination.

The sums would then be attributed “subject to the establishment of a figure economically aligned with the managerial one, through resolutions of the President’s Office”. The resolutions would have violated a series of rules. According to the investigators, there would be a lack of a state legislative source, they would elude a constitutional ruling and they would trespass within the scope of competence of the national legislature. In addition, they would conflict with the national employment contract and with the same regional legislation introduced in 2021. The aforementioned ruling of the Consult dates back to 2002, and declared some parts of a regional law in Campania to be illegitimate. The affected law, at the time, established additional funds to finance the allowances to be paid to seconded or seconded staff serving on the staff of commission presidents, members of the Bureau and council groups, and for staff serving at the organizational structures of the Regional Council. The tax investigation arose from an article in the newspaper La Repubblica and a subsequent anonymous complaint. Now the defendants, within 45 days, can deposit their deductions and any documents in the secretariat of the Court of Auditors.
