CATANIA – The condemnation to six years of imprisonment it arrived just under a month ago. A reversal of the first degree sentence that she had acquitted Salvatore Chisari from the accusation of having taken part in the group of fire which on 8 August 2020 had unleashed an inferno which left two victims and several injured.
In the last few hours, the reasons for a sentence of the Court of Assizes of Appeal to which the deputy prosecutor Ignazio Fonzo and deputy Alessandro Sorrentino.
“Abject and futile motives”
The Court held that the aggravating circumstances of the shooting were recognizable in the motive for the shooting abject and futile reasons in relation to the figure of Chisari. The developments of the process have made it possible to ascertain that the components of the Hat Clan organized the punitive expedition against the group of Cursoti Milanese as an action to assert its mafia strength as a result of previous conflicts that arose between the two mafia-type criminal organizations.
“Break them all”
For his part, Salvatore Chisari, declared that when “Lombardo Salvuccio junior said we had to go to look for Distefano and his group to smash them allmade no reference to the need to go and get weapons […]
I reiterate that I was not armed and I don’t know if anyone else in the group was […] Nobile Gaetano told me that they had no weapons, although it seems strange to me that they went to Viale Grimaldi 18 without taking precautions.
When our group set off from Monte Pidocchio, I was fully aware that we were going looking for the Milanese to teach him a lessonbut I had absolutely no knowledge of the presence of firearms nor did I imagine that the epilogue could be what actually occurred.”
The aggression
The Court of Assizes of Appeal therefore held that “Chisari, although not organically part of the Cappello clan, due to his closeness to his brother-in-law Gaetano Nobile and other members of the Cappello clan, was fully aware of the conflicts existing between the Hat and in particular of the attack suffered by Nobile the previous day”.
Participation in the expedition
For the judges, Chisari (who joins the fire expedition with several armed men after their departure) arrives in San Giorgio and near the roundabout which is located near the carabinieri barracks, despite sensing that shots have been fired, “without any hesitation and without desisting from his conduct he headed towards that point, therefore ready to participate together with the members of the Cappello in the planned punitive expedition against the Milanese Cursoti.
All this certainly leads us to believe that Chisari, contrary to what was asserted at the hearinghad the precise desire to arrive at the aforementioned places to also participate in the punitive expedition”.
The fraud
Finally, for the Court, “the hypothesis of attempt, while it is not compatible with possible intent, is compatible with it particular form of direct fraud which is alternative fraud”.
