“The criminal liability of entities: evolution, changes and state of the art”: this is the theme of the conference held yesterday at the Pescara Courthouse

In particular, the full title was: “The criminal liability of entities: evolution, changes and state of the art of the MOG231 and the ODV”.

The symposium was attended by representatives of the judiciary, the Pescara Yellow Flames and the Generazione 231 association. The event began with greetings from the Chief Prosecutor of the Public Prosecutor’s Office at the Pescara Court, Giuseppe Bellelli, the president of the Pescara Bar Association, Federico Squartecchia, the president of the Pescara Criminal Chamber, Massimo Galasso and the president of the Generazione 231 association, Valerio Silvetti.

Then came the interventions of the speakers: the Deputy Prosecutor of the Republic at the Court of Pescara, Annarita Mantini, the Provincial Commander of the Guardia di Finanza of Pescara, Antonio Caputo, the chartered accountant and PA consultant on Anti-Corruption, Marco Berardi, and the vice president of the Generation 231 association, Francesca di Muzio. The lawyer Gianvito Rizzini, vice-president of the Generazione 231 association, introduced and moderated the conference.

The Provincial Commander of the Guardia di Finanza of Pescara gave a speech entitled “The Guardia di Finanza and the administrative responsibility of the entities: strategic lines, intervention methodologies and operational experiences”.

In his report, Colonel Caputo underlined the centrality of the role of the Guardia di Finanza, as an Economic-Financial Police Force, in ascertaining the criminal liability of entities, by virtue of the fact that the majority of the underlying crimes fall within the specialized competences of the Yellow Flames. Furthermore, the Commander highlighted that the important role of the Financial Police is also linked to the type of investigations to be carried out in this area, firstly to identify the “economic advantage” achieved by the Entity as a result of the commission of the predicate crime; secondly to quantify the sanction, commensurate with the economic capacity of the legal person, which requires investigations and inspections typical of the economic-financial police.

Caputo concluded his speech by proposing the organization of further meetings on the topic and by proposing the availability of the Fiamme Gialle to act as the privileged contact of the judicial authority in the specific sector, in order to fully exploit the skills and experience gained over time in the field in this context.
