PADUA – He relied on his lawyer Daniele Pagin, owner of the Santa Lucia wine shop and the Pepen restaurant in Piazza Cavour, to refute the warning and the complaint filed by the Palazzo Cavour Donà condominium. According to the tenants, those two places disturb with music at full volume, but for the lawyer Marco Ferraresso these are only accusations “totally unfounded both in fact and from a legal point of view”. Arguments that the lawyer not only sent to the opposing party, but to the mayor and councilors and to the police.

“The condominiums complain about the lack of permits to hold musical events”, but for the lawyer the opposite is true. “As can be easily verified by accessing the administrative documents in the Municipality from which it would have emerged incontrovertibly, that the musical entertainments are all authorized pursuant to the Law and the current Municipal Regulations for the regulation of noisy activities on the terrace attached to the restaurant – explains the lawyer – as far as the Pepen restaurant is concerned exclusively, at the beginning of this year all the legislative and regulatory procedures were carried out to manage the acoustic impact of the ordinary activity, from 6 to 22 and of the derogation activity from 22 to 6, of the musical events with the primary aim of causing the least possible inconvenience and/or annoyance to third parties, first and foremost the residents and thus guaranteeing the public and private peace of the area, on the basis of the reports, including forecasts, in the documents of the specialized technician”. Ferraresso also underlines that in the past months, no resident and even less the condominium administrator has ever complained to the owner nor with the staff of the two premises about the alleged “noise pollution”, so much so that he learned the news from the local newspapers including the existence of “checks carried out” on the decibels emitted by the music of the premises which would greatly exceed, as the condominium owners claim, those permitted . «On all musical evenings the limits were always respected for the noise emissions required by law, both for activities authorized with ordinary hours and for those, rarer, with music until midnight authorized in a maximum of 15 per year. All then provided with authorization through Suap and the Environment office with an advance of at least 30 days with respect to the date of execution – Ferrarresso closes – Furthermore, on the same evenings with music authorized until midnight, in order not to disturb rest and protect people’s health, the music always stopped at 11 pm”.
