TRAPANI – The financiers of the Provincial Command of Trapani, at the disposal of the Public Prosecutor’s Office, have implemented the real precautionary measure of the preventive seizure, issued by the investigating judge of the local Court, of the shares and the business compendium of three active San Vito lo Capo companies in the hospitality sector for a total value of Euro 1,200,000.00, belonging to two spouses, under investigation, in various capacities, for the crimes of fraudulent bankruptcy and self-laundering. The precautionary measure of the residence ban in the Municipality of San Vito Lo Capo and the ban on carrying out business activities for a period of one year were also applied to the latter. The provision arises from tax police activity carried out by the soldiers of the Economic-Financial Police Unit of Trapani, against two limited liability companies operating in the tourism sector, belonging to the same dominus, one of which was found to be non-compliant to the obligations to pay taxes for over 1 million and 200 thousand euros and that, at the request of the Investigating Magistrate, the “bankruptcy” occurred. The investigations carried out, made particularly difficult by the irregular keeping of accounts, such as not to allow an easy reconstruction of the movement of business, have made it possible to reveal a criminal plan, specifically conceived by a single director attributable to the suspects and the result of complex planning, perpetrated above all through the diversion of capital goods owned by the bankrupt company in order to guarantee business continuity through two further companies with the same corporate structure and governance as well as coinciding legal and operational offices. The seizure of company shares, as well as of the assets illicitly acquired by them, will be able to guarantee both the tax claim and the continuity of the company activity, following the appointment of a judicial administrator for this purpose by the Judge. The operation under review confirms the fundamental economic-financial police role played by the Guardia di Finanza, in close synergy with the Judicial Authority, to guarantee compliance with competition and market rules and to protect companies that operate fully and conscious compliance with the rules. For the purposes of exercising the right to freedom of the press, which is constitutionally guaranteed, and in respect of the rights of the suspects, the latter are to be presumed innocent until the irrevocable sentence which ascertains their guilt.
