ANCONA – The Police Commissioner of Ancona has issued a new warning provision ex art. 8 of Law 38/2009. The article of the cited law allows victims to stalking to report the facts to the Public Security Authority and to request a warning from the Police Commissioner against the perpetrator of the conduct.
In the first half of 2023 they had only been issued 17 measures of warning, both for conduct related to stalking. In 2024 and up to today, however, this important prevention measure has seen a markedly growing trend: from 1 January to today (26 June 2024) a good number of 40 measures, thus exceeding the total number of warnings issued throughout last year (n. 38). The data could cause concern but it is good to remember that in no relapses were recorded and, therefore, in all cases in which the prevention measure of the warning was intervened, this truly had a deterrent effect on the perpetrators of the conduct.
The latest provision was issued only a few hours ago against a Italian manabout 20 years old (already the recipient of another prevention measure) who, as often happens, had continued to look for insistent contact with your ex, despite him having a new partner. In fact, often the persecutory attitudes were carried out by the man together with his new partner towards the ex and consisted of frequent and insistent calls, messages, including via social media. Not only that: on some occasions the couple insulted and threatened the victim when by chance they found themselves in the same places.
On one occasion the young man had snatched her hands from her car keys, threatening her. This had forced her to change her lifestyle habits and no longer frequent certain areas for fear that she might find her ex in front of her in the company of her new girlfriend who threatened and insulted her. The woman, exasperated by these oppressive attitudes, had asked for help from the policemen of the Anti-Crime Division of the Police Headquarters who, quickly, helped her get out of this situation, guaranteeing her rapid and effective protection.
Finally, it is remembered that, as is also explicitly communicated to the recipient of the measure at the time of notification, if a person who has already been warned continues to harass the injured party, the conduct becomes prosecutable by the Police Office, without the need for a specific complaint from the victim .

The decisive role now falls to the community: the more a woman feels protected in the context in which she lives, the more she will understand that a slap, an insult received, a threat are only the precursors and that turning to the police it is not an act to be feared or ashamed of, but the right, effective solution to a spiral of violence or persecution suffered and which must be interrupted before it degenerates.”
