Lamezia Terme – “The examination carried out by the appeal judges regarding the identification and identification of Gallo as the perpetrator of the murder is congruous and not illogical – as such, inexcusable”. the judges of the first section of the Court of Cassation (president Monica Boni, rapporteur judge Vincenzo Siani) wrote it in the thirty pages that contain the reasons for the final sentence of conviction for Marco Gallo held guilty of the murder of Gregorio Mezzatesta, which occurred in Catanzaro on the 24th June 2017. The magistrates of the Supreme Court, who therefore confirmed the life sentence issued in second instance by the Court of Appeal of Catanzaro, retrace the various procedural phases in which Gallo was accused, focusing on the reasons that pushed the lawyers Francesco Siclari and Antonello Mancuso to appeal to the Court of Cassation against the life sentence; explain the reasons why the defenders’ requests must be considered “inadmissible and why – on the contrary – the second degree sentence issued in Catanzaro must be fully confirmed”. Long sections of the reasons are dedicated to the use of some evidentiary elements, from the video surveillance images to the access to the convicted person’s email account, and then arriving at the conclusion of the rejection of the appeal. For Gallo, this is the third life sentence, after that relating to the murder of the greengrocer Francesco Berlingieri, killed in front of his shop in via Fiume in Lamezia on 19 January 2017, and of the lawyer Francesco Pagliuso, shot dead in front of his house on 9 August 2016. Mezzatesta was an employee of the Calabria Railways, killed in via Milano, in Catanzaro upon his arrival at work. He was the brother of Domenico Mezzatesta, the man who in January 2013 with his son Giovanni was responsible for the double murder in the “Reventino bar” in Decollatura of Francesco Iannazzo and Giovanni Vescio.
