“Even if Paola Egonu has Italian citizenship, it is evident that her somatic features do not represent Italianness” Vannacci had written, words which according to Dal Torrione are not defamatory, but “improper and inopportune“.

According to the investigating judge “however, there is no evidence of an exceeding of the limit of continence which could be said to be indicative of a desire on the part of the suspect to gratuitously offend the reputation” of Egonu, “to denigrate it, to diminish its value, to carry out an undue attack to the person.”

General Vannacci rejoices

Upon hearing the news of the decision of the investigating judge of Lucca, General Roberto Vannacci he smiled and cheered.

In a note issued by his lawyer Massimiliano Manzo, the new MEP underlined that the one obtained “it is the victory of freedom of opinion“.

“I was calm and today I am extremely satisfied with the sentence issued by the investigating judge of Lucca, Alessandro Dal Torrione. It has been recognised, as always stated, that there was no intention on my part to gratuitously offend Egonu’s reputation, denigrate it or diminish its value” explained Vannacci.

The general then thanked the public prosecutor of Lucca “for his initial request” and the “judge for having listened to our reasons and having recognized the right balance between expression and respect“.

On the other hand, he wishes volleyball player Paola Egonu “an excellent continuation of the season and many victories”.

The response of Paola Egonu’s lawyers

A decision, that of the court of Lucca which accepted the request of the prosecutor’s office, which leaves Paola Egonu surprised. The team of lawyers assisting the Italian volleyball player, in fact, said they were shocked by the decision to dismiss the complaint.

“Unexpectedly archived, we will evaluate other actions. Unacceptable decision” said Simone Facchinetti, Egonu’s lawyer.
