Stop the mega antenna, decision next year

Hoisted amid controversy at the end of January. It remained firm awaiting the precautionary hearing at the end of February in which the Marche Regional Administrative Court denied the suspension. And in the following weeks, it seems, it became operational. There remains a forced coexistence between the 34 meter antenna positioned in Ancona (in a private field on the border with Falconara) and the residents of Via Panoramica (where the infrastructure is located). And a forced coexistence that will remain so, incredible but true, at least until March 6, 2025.

The date on which the Regional Administrative Court will decide definitively on the merits of the installation. The two lawyers of the Doric forum Massimiliano Bossio and Giorgio Valente reported this to Carlino yesterday, after having presented three withdrawal requests. The lawyers have been following the case for months on behalf of the 92 inhabitants of Palombina Vecchia. A match which, at the moment, sees Inwit and Vodafone ahead 1-0. It is no coincidence, in fact, following the hearing of 22 February, between the end of that month and the beginning of March the TAR denied the request for suspension.

A clear decision, despite the fact that the Marche Court itself had deemed the preliminary and preliminary questions presented by Inwit to be outdated. The antenna, built as part of the European Next Generation Eu Plan and implemented thanks to Pnrr funds, had remained offside for some time. But the failure to accept it, however, had in fact allowed the two telecommunications companies to take over. Only if the TAR had recognized the irreparability of the damage due to the installation of the system (not verifiable a priori if it was turned off, but also authorized by Arpam), could it have accepted the suspension of the contested measures. The other criterion, however, is the one that keeps the residents’ hope alive, that is, the manifest validity of the appeal itself in which, through the lawyers, “procedural defects in the documents were highlighted, some of which are contested, and missing or missing documentary production submitted late”.

Not to mention, then, the reports of “possible damage to health, to the environment, to the landscape due to the impact and to the economic damage due to the devaluation of the properties”. Following the withdrawal requests presented by Bossio and Valente, the TAR set the date. However, it will take nine months of patience before knowing the final decision. The same college, curiously, will also have to rule on the antenna in via Tonnini in Osimo on 6 March 2025. But it is a diametrically opposite situation compared to that of Falconara: it is in fact Iliad who has lodged an appeal against the self-defense cancellation of the authorization against the Municipality of Osimo.
