A tug of war that lasted almost fifteen years: on the one hand a company from La Spezia which claimed over 70 thousand euros for work which it said was carried out but never paid for by the Municipality, on the other the municipal administration which has always opposed the payment, supporting that those works had in fact been carried out by other companies. An affair that in recent days has found the first ruling of justice, with the civil court of La Spezia rejecting the company’s claims, condemning it to pay over 25 thousand euros in legal costs towards the Municipality and the mayor and two councilors of the council who was recently leading the territory. The La Spezia company complained that from 2010 to 2012 it had carried out work on behalf of the Municipality of Riccò
works to adapt and make the electrical systems safe and fire prevention works in numerous structures located in the aforementioned Municipality: in particular in the Gindoli primary school, in the Sironi middle school, at the municipal library, in the San Benedetto cemetery and in the local playgrounds municipal. According to the company, many of these works were carried out on the orders of the municipal administration without them having ever been formalized in administrative documents and without formal commitment of the related investment expenditure. The Municipality has a different opinion, which paid the company for the work actually carried out while it rejected the interventions mentioned by the company itself, as “never carried out by it: the further works had been entrusted to other companies”. Hence the notice of the legal battle, with the company which, after having unsuccessfully requested payment for the works, knocked on the civil court of La Spezia to ask for the Municipality to be condemned to pay 70,329.04 plus VAT. Judge Tiziana Lottini ruled in favor of the Municipality, as the company did not provide “proof of the actual execution of the works themselves and therefore of their own decrease in assets and the enrichment of the Municipality”.
