The ASL does not respond and the family members do not show willingness to take her in for treatment: she ends up in a judicial psychiatric hospital under the Rems regime. She was acquitted a few days ago of the most terrible of her crimes, the murder of her son, who was just two and a half years old, because at the time of the facts she was not deemed capable of understanding or will.
Now, however, Adalgisa Gambathe 42-year-old from Torre del Greco detained since January 2, 2022, when she suffocated her son Francis and was found on a cliff in the icy waters of the winter sea, risks becoming a case. The judges, in fact, found that a week after the note sent to the ASL Napoli 3 Sud and in the absence of alternatives (family members or other subjects), the woman cannot be subjected to probation for a period of no less than 15 years as provided in the sentence.
Adalgisa Gamba, in fact, could have enjoyed the particular restrictive measure, with the obligation of treatment and residence in a high-intensity therapeutic-rehabilitative residential facility, with a suitable therapeutic plan, but no one was available, not even the family members who had attended all the hearings of the trial which ended ten days ago in the Court of Assizes in Naples. Therefore, the judges took a step back and accepted the request of the Power of attorney of Torre Annunziata (prosecutor Andreana Ambrosino at the hearing) and ordered the woman’s transfer to a judicial psychiatric hospital, as she requires specific care.
The 42-year-old is still considered seriously ill and still “dangerous”. Various psychiatric reports certified her clinical state, the last one carried out by a panel of consultants and specialists at the request of the Court, since the judges had a series of doubts about the defendant’s capacity to understand and will, which she it would have killed his son Francesco because he had diagnosed him with autism through Google searches.
Doubts that had been raised several times by the prosecution, who had collected her confession on the beach of Torre del Greco and during two interrogations, but also by the civil party (her husband Elio, represented with the lawyer Luigi Ulacco) who, through a biased expert opinion had always supported the woman’s precise will and the premeditation of the terrible murder. Now, from Avellino prison, Adalgisa Gamba she was released from prison and will be transferred to a judicial psychiatric hospital, where she will be under treatment. And she will be alone.
