There regional councilor of Parità Pipponzi invited the mayors elected in the electoral round of 8 and 9 June to respect the gender quotas for a correct composition of the councils.
He has declared the Equality Councillor:
“The lack of gender representation is detrimental the principle of equal democracy, depriving the administrative activity of a different perspective and a vision that only the harmonious co-presence of men and women can provide to build a more just and equal society”.
Going into detail, the rules establish that the mayors of municipalities with a population of less than 3,000 inhabitants must guarantee gender representation in the councilsan obligation which is valid, the Councilor clarifies, also for the collegial bodies of the Municipality and for the bodies and organizations dependent on it.
Since the gender quota that must be ensured is not specified, it follows that in these administrations the rules that provide for the presence of the less represented sex in an amount of no less than 40 percent of the members of the collegial body are not binding.
If the mayor decides to derogate from the principle of equal representation, he is required to adequately justify his choice.
And if the municipal statute provides for it, it is possible to draw on an external councilor following a request addressed to the less represented gender, as established by sentence No. 237/2018 of the Basilicata TAR which annulled the union resolution of a Lucanian municipality with less than 3,000 inhabitants.
In municipalities with over 3,000 inhabitants, however, neither sex can be represented by less than 40 percent with arithmetic rounding.
Obviously, the rule of the need to document the investigation carried out to guarantee gender representation also applies to these municipal administrations.
