The truck driver German who hit the cyclist Davide Rebellin returns to Germany. Wolfgang Rieke, 64 years old, would not be in good enough health to support the first hearing or house arrest. The decision was taken by the president of the collegiate court of Vicenza, Filippo Lagrasta, because the man suffered a stroke in critical health conditions. Therefore, he could leave the Treviso clinic where he is hospitalized to go to a hospital in Germany. The man hit the cyclist with his truck on November 30, 2022 in a roundabout in Montebello Vicentino and then fled.

The judge’s decision

The judge wrote that “the defendant’s treatment needs appear incompatible with the persistence of the limitations linked to the execution of the precautionary measure in place”. He justified his choice as follows: «From the state of health described by the treating doctors, it follows that the precautionary needs originally found in relation to the risk of recurrence of the crime are overcome, which is no longer concrete and current, since the accused is incapable of walking in autonomous way”, and therefore, “he does not appear to be absolutely capable of driving any motor vehicle”.

Rieke had tried to hide evidence of the murder

The next hearing was scheduled for June 24. Last March 11, Judge Lagrasta rejected the plea deal (3 years and 11 months) advanced by Rieke’s lawyers, Enrico Ambrosetti and Andrea Nardin. The request, deemed inadmissible, started the hearing. The man also has the aggravating circumstance of fleeing after having erased the most obvious traces of blood for fifteen minutes. Rieke had also returned home to Germany, via back roads to avoid being spotted, replaced the trailer and washed the truck to remove any signs of the impact. He was pinned down by the video surveillance cameras in the area. Knowing he had been spotted, he later showed up spontaneously at the Brenner Pass.
