BARI – The financiers of the Provincial Command of Bari are executing, in Bari and its province, a personal and local search decree against 4 individuals and 5 companies, issued by the Public Prosecutor’s Office, on charges of fraudulent bankruptcy in the construction sector . Under investigation is a series of operations implemented by a company (and in one case by its parent company), for which the composition with creditors procedure is underway, established following the appeal for the opening of judicial liquidation advanced by the Public Prosecutor’s Office in 2022.
The recipients of the measure are under investigation for the criminal hypotheses of fraudulent bankruptcy of assets due to distraction and improper (from malicious acts and false corporate communications). The company subjected to the composition procedure would have stipulated 3 preliminary contracts for the purchase of company shares from a counterparty (attributable to the same family unit), in which the payment of advances for more than 20 million euros was envisaged. Nonetheless, in one case, the definitive contract was never reached; in another, the contract was signed only 12 years later, when the shares to be purchased no longer had any value; in yet another the original agreements were resolved by consensus several years later. Furthermore, over time, the legal representatives of the company investigated did not make any effort to request the refund of the sums paid.
These actions would have led to the liquidity crisis and the impoverishment of the company’s social assets. The searches aim to acquire all the documentation useful to support the investigative hypotheses.
