CONFSAL Local Functions represents and observes: “that as appeared in “IL MATTINO” of (Thursday) 31 May 2024 and Gazzetta di Benevento and NTR24 of 30 May 2024, “we have learned a long and detailed note from the former Police Commander Municipal of Benevento, BOSCO Fioravante, in service until 31 January 2024 (now retired), where he represents the Municipal Secretary, Dr. Feola, having become aware of Managerial Determination No. 21 of 15 May 2024 (General Register No. 643 ) having as Object: “cancellation of the evaluation forms of the employees of the municipal police force, signed by the Municipal Secretary himself, with immediate request for revocation as “Illegitimate”, recalling a series of regulations and jurisprudential on the contrasting functions between the Municipal Secretary and the Commander of the Local Police, referred to in the Framework Law of the Local Police No. 65/1986 “.!
From what can be read from the long and detailed note addressed to the Municipal Secretary of Benevento, Dr. FEOLA, which has already appeared in various newspapers and online as in the epigraph, the former Commander of the Local Police of Benevento (now retired!), invites the same Secretary, to proceed without delay with the revocation of Managerial Determination No. 21 of 15 May 2024 (general register No. 643) having as its object: “Cancellation of the evaluation forms of the employees of the Municipal Police Corps”, with the restoration of the staff evaluation forms for the year 2023, with the notice at the expiry of the legal deadlines, it will proceed to appeal to the competent judicial authority….”.!
The CONFSAL Local Functions represents and observes and asks itself a question: 1)- “If the criteria for holding the ranks and functions of Commander of the Municipal Police of Benevento by length of service have been respected, as regulated by the Regional Regulations of the Local Police of Campania No. 1/2015 with attached tables A)- B)- C)- and D)-, as implemented with Benevento City Council Resolution No. 141 of 28 September 2015 “?
2)- “If the same officers of the Municipal Police of Benevento classified in Category D/1, charged with coordination and organization tasks of the Services having been appointed Deputy Commander (Major) and Commander (Lieutenant Colonel) by Union Decree, have accrued in accordance with the Regional Regulations of the Local Police
No. 1/2015, the requirements for the functions and ranks assigned to them “?
3)- Whether the current Commander of the Municipal Police of Benevento classified in category D/1 appointed by Union Decree has the requirements to hold the functions and ranks attributed by length of service to “Lieutenant Colonel”, with the functions of Police Commander Municipality of Benevento (as regulated by the Regional Regulation of Campania of the Local Police No. 1/2015 and implemented by the Resolution of the Municipal Council of Benevento No. 141 of 28 September 2015) “?

Also, as CONFSAL Local Functions, to know whether the Organizational Position (now High Qualification) has also been attributed to the functions of Local Police Commander and to know how many Traffic Police of the Municipality of Benevento have requested according to what is established by Law No. 311/2004, the secondment to other Municipalities of the Local Functions Sector “.!
Now as CONFSAL Local Functions we are curious to know what the contents of this long and complex dispute open between the former Commander of the Local Police (now retired) and the Municipal Secretary, Dr. FEOLA”? And why only today does he claim the five years of experience in the functions carried out for the high service provided, including as Head of the Local Police of the Municipality of San Lorenzello”?
