Teramo, refused visits and injuries: double trial of the doctor

The Local Health Authority had already been informed for years, and by the patients themselves, of the behavior of the doctor of the Notaresco continuity of care service, but nothing was ever done, not even at a disciplinary level, and even from the Urp the answers that were sent back those complaints were “the same justifications given by the doctor”. In the end the intervention of the judicial authorities was needed and so Lino De Sanctis found himself with two criminal trials in progress which will not be consolidated.

THE HEARINGS
Both hearings took place yesterday and in both cases the 60-year-old doctor from Silvi, but working at the care continuity service of Notaresco, is accused of refusal of official documents, in the most recent file, the one for which he last December he was also suspended from work by the investigating judge for a year, then reduced on appeal to two months, also for personal injury aggravated by having committed the act with violation of the duties inherent to a public function or a public service (defenders are, in first case, the lawyer Mariella Di Nisio, in the second, the lawyer Antonino Orsatti). Neither the local health authority nor the patients took action as civil parties. In the latest proceeding, yesterday, a policeman from the Nas of Pescara was heard who followed the investigations and who spoke of “documentation found on complaints, also sent to the URP of the ASL, dating back to 2017 and 2018”. In short, everything was put down in black and white by the patients and now also included in the documents of the other trial, which clearly concern different facts, but which demonstrates, in that case too, how the ASL was aware of everything, even though denying knowledge of when the doctor was suspended.

THE EPISODES
What pushed the investigators to ask the judge for the disqualification measure was the last episode contested by the prosecution which dates back to last November, when, while he was on duty at the Notaresco continuity of care service as a healthcare provider in general medicine, he allegedly yanked the family member of an elderly woman who had gone there to ask for a home visit for her mother until he fell down the stairs. There is talk of a blow to the railing which caused a seven-day injury, with the benefit reportedly being refused. Then, however, there are also two other previous episodes, both dating back to 7 January last year when the police were called, also on that occasion. In one case a mother had turned to the former medical guard because her minor son had an earache. The doctor claimed that he had requested a swab before the visit which would have been refused. And finally there is the dispute in this case, however, of the diagnostic tests during a home visit to an elderly woman who was apparently assessed superficially, admitted on the same day to the emergency room of Giulianova hospital for a bilateral pleural effusion. Yesterday, the lawyer Orsatti focused on the regulations that at that time were still in force in medical clinics regarding the swabs that De Sanctis would have requested from two patients, including the minor, before the visit. As well as the working hours that the doctor had carried out in those days. Aspects that will be explored further.
