COLLESALVETTI. He was sentenced to eight years, one month and ten days in prison for aggravated sexual assault. This is the sentence decided, in first instance and in abbreviated proceedings, for the owner of an estate in Collesalvetti, who The Tyrrhenian Sea it does not report the name and surname so as not to make the victim of the alleged rape recognizable. This is a boy who, the year in which the disputed events allegedly occurred, was 16 years old: a friend of the accused’s nephew, a man who was 66 at the time and is now 73.

The accusation

The alleged sexual assaults, four according to the prosecutor’s office, would have occurred during 2017. The young man, a Livorno who is now 23 years old, would have met the owner of the estate located in the municipality of Collesalvetti thanks to the latter’s nephew, the at the time one of his best friends. He would have given a hand to the boy and his uncle in a friendly way, working within the agricultural area. Then, however, by frequenting that house, the nightmare would begin. With the alleged rapes – according to what was reported by the then sixteen-year-old, who obviously spoke about it with his mother – and the awareness that the minor then transformed into courage to file a complaint. One of the episodes apparently occurred during a break in work on the estate, for lunch. Alleged sexual relations, all non-consensual, within the home. Accusations, those of the young man, which have required many investigations in recent years by investigators, with the twenty-three-year-old and his mother who then became civil parties during the criminal proceedings that were opened.

The defence

The seventy-three-year-old always defended himself by explaining that he had never had any sexual intercourse with the boy (then a minor) and that, during breaks from work in which they would be left alone at home, nothing would happen. He therefore considers himself totally innocent with respect to the prosecutor’s accusations, with the file that had been opened for the crime of aggravated sexual violence by the public prosecutor Giuseppe Rizzo, the head of the investigation, even if in chambers a few days ago on the my colleague Ezia Mancusi was present at the sentence.

The process

The man, at his request, was judged with the abbreviated trial, a process which provides for a quicker trial in exchange for an automatic discount of one third of the sentence. The prosecutor, in her conclusions, had asked for a 15-year prison sentence for the owner of the Colligiana estate (ten, including a discount of one third), but the judge for preliminary investigations Marco Sacquegna, while sentencing him, reduced it two years.

The sentence

It will take 90 days to read the reasons for the sentence, which was pronounced last Tuesday in the council chamber of the court in via Falcone e Borsellino.
