Letter of apology from De Magistris to an entrepreneur from Catanzaro

The former prosecutor of Catanzaro and former mayor of Naples, Luigi de Magistris, wrote a letter of apology to an entrepreneur from the Calabrian capital, Maurizio Mottola di Amato, who had initiated a civil lawsuit against him for some statements made by de Magistris himself in 2010, in the period in which he was a European parliamentarian. The text of the letter was published by the “La Nuova Calabria” website. De Magistris had been sentenced by the Catanzaro Court of Appeal to pay damages to Mottola di Amato after the Court had rejected the request at first instance in consideration of the immunity deriving from his position as a European parliamentarian. The request for compensation against De Magistris had also been made by his wife Mottola Of Beloved, Abigail Mellace, judge of the Court of Appeal of Catanzaro. De Magistris’s appeal sentence was then confirmed by the Court of Cassation. “At the end of the long dispute which unfortunately saw us at odds from 2011 to 2023, following the ruling of the Court of Cassation which deemed the expressions I publicly addressed towards you defamatory – writes De Magistris in the letter to Mottola di Amato – I would like to express to you the I deeply regret having offended your reputation, even though these were never my intentions. Least of all did I want to question his person on both a personal and professional level. Just as it was not my intention to cause any offense to your wife in the most absolute way, and I regret that this is how my statements were perceived, not questioning her professional abilities as a magistrate. I can only be happy for her that the preliminary investigations directed by me, at the various levels of judgment, proved to be unfounded towards her, leading to no responsibility and therefore demonstrating the goodness of her reasons”. “Ultimately, believing that after so many years time can thin out moments of very serious tension which involved us from opposing positions – states the former prosecutor of Catanzaro – today I can only ask you to accept my apologies, if with my words, my despite this, I have damaged your reputation, hoping that this will be enough to restore your personal, business and family serenity that I have greatly disturbed and compromised in the past”.
