In the past few days, staff from the administrative and security team of the Police Headquarters carried out an administrative check at a well-known restaurant in the center with the aim of verifying the regularity of the licenses and work positions of the staff employed.

On site, both in the kitchen and in the dining room, some workers were identified intent on preparing food and serving customers positioned at the restaurant tables. Among the employees there was also a 24-year-old young man intent on carrying out the duties of a waiter. From an initial check and from the information obtained from the owner, it was clear that the young man had been employed “off the books” at the restaurant, without any contract and paid in cash with around 40 euros a day. But subsequent checks made it possible to ascertain that the young man hired illegally was instead working, with a regular apprenticeship contract, at another well-known restaurant in the province, and that he had been on sick leave for a few months. The INPS, appropriately requested, confirmed both the existence of the employment contract and the illness currently enjoyed by the employee.

Therefore, following the findings that emerged, the young man was referred to the AG for the crime of aggravated fraud, as he used tricks to mislead his owner as well as the National Social Security Institute, which had paid him the monthly illness.

This Office also sent a report to the GDF group asking to suspend the activity of the Ancona restaurant pursuant to art.14 of Legislative Decree 81/2008 due to the presence of the irregular worker. The labor inspectorate, following a report from the GDF, consequently issued a provision suspending the public business, but the suspension was avoided because the owner paid the expected administrative fine of 2,400 euros and regularized the position of the illegal employee .
