Palermo, attacked his friend during an argument: sentenced to one year

PALERMO – The Palermo gup Paolo Magro has sentenced in abbreviated form Michele Mercurio to one year and 8 months for injuries. LThe charge was attempted murder to the detriment of Fabio Puleo, who was attacked during an argument.

The preliminary hearing judge, accepting the requests of the lawyers Salvino and Giada Caputo and Francesca Fucaloro, reclassified the crime of attempted murder as injury and acquitted the accused of charges of carrying and possessing a weapon. The events date back to 29 June 2023 and occurred in the Borgo Nuovo neighborhood of Palermo.

The reconstruction

Puleus had given to Mercurywhich has a cat colony, a dog. A few days later she requested it back. An argument arose at the height of which Puleo allegedly threw a hoe and other objects at the victim.

During the discussion the accused squeezed the other’s neck until he fainted. The latter to free himself he hit him with a knife as a diver causing shallow injuries. It was Mercurio himself who called 118.

The medical examiners, appointed by the prosecutor’s officealthough not clearly highlighting the danger to life, they ascertained that the blows inflicted were close to vital organs.

The forensic medical consultants appointed by the defense, however, stated that Puleo had never been in danger of his life and that none of the vital functions had been compromised. The prosecutor had requested a 4-year sentence.

“We have demonstrated – specified the lawyer Giada Caputo – that our client acted in a state of anger determined by the unjust act generated by the provocation due to Puleo’s violent behavior.”
