Below is the note from the opposition councilors to the municipality of Teramo who announce the formal request for a commission of inquiry after the TAR ruling on the issue of the municipal theater and the Sottosopra commercial premises, and the preparation of a complaint to the court of auditors.
Following the pronouncement by the Abruzzo TAR of the well-known conviction sentence no. 00192 of 27 March 2024 published on 18.4.2024 relating to the renovation works of the municipal cinema-theatre of Teramo with which the Administrative Judge, in recognizing part of the reasons of the appellant private party, condemned the Municipality of Teramo to pay the sum of E. 685,850.47 in addition to legal costs as compensation, stating, among other things, the existence of a “NEGLIGENT CONDUCT OF THE ADMINISTRATION” “CONTRANY TO THE PRINCIPLES OF GOOD FAITH AND TRUST OF THE PRIVATE INDIVIDUAL”, the undersigned Municipal Councilors of minority of the Municipality of Teramo, on …. have deposited at the municipal headquarters the formal attachment requested from the Mayor, the President of the City Council and the General Secretary of the Municipality of Teramo:
the extremely urgent constitution, pursuant to and for the purposes of article 30 of the current Municipal Statute and article 41 of the Municipal Council Regulations, of an investigation commission to ascertain, or to verify, the regularity, the correctness and legitimacy of the municipal administrative activities subject to findings and censures by the aforementioned Sentence in order, in particular, to proceed with the checks, investigations and investigations to be carried out in relation to the facts, deeds, provisions and behaviors maintained by the members of the Municipality (in particular: by the Mayor pro tempore, by the executive body, by the managers of the offices or services, and/or technicians appointed by the Authority, or by representatives of the Municipality in other bodies).
the immediate start of the relevant procedures, including the setting of a dedicated and specific board meeting, also with the aim of facilitating the Board itself in the exercise of its political-administrative control functions.
The undersigned councilors are also preparing a formal complaint to the Court of Auditors.
The very serious situation that has arisen in this regard, which unfortunately fits into an increasingly deeper wake of alarming events generating damage for the City and citizens, requires, in fact, the utmost seriousness, transparency and attention.
