Foggia. At the hearing on 23 April 2024, the Court of Foggia, panel E presided over by Dr. Mario Talaniacquitted because the fact does not exist a pensioner from Troy of the accusation of sexual violence continued for about a year against a girl under the age of ten.
The Foggia Prosecutor’s Office had requested a four-year prison sentence.
The man, since the first interrogation, has always protested his innocence. He was also subjected, for approximately six months, to the measure of house arrest, ordered by the Review Court.
The lawyer Michele Vaira, defender of the accused: “I was very confident in a rigorous evaluation by the Court, but it was still a great relief, both for my client and for the entire family, all respectable people, who were overwhelmed by a completely unjustified shame. I am doubly happy because we believe we have demonstrated that the minor never suffered any of the terrible acts of which my client was accusedbeing the fruit of his imagination, fueled by a family environment of serious hardship”.
“Unfortunately, at the time of making the first statements, the minor was interrogated using inappropriate methods, in the presence of a consultant who validated her credibility with “copy-paste” arguments from other completely different cases and devoid of any scientific nature. Another great reason for satisfaction is having closed the trial in less than two years, despite having opted for the trial solution.”
