About 12 years ago, when he was 16, in the gym of a high school in Sienawhere she was in her third year, was hit in the right eye by a basketball, thrown forcefully at “head height” by a classmate, while the physical education teacher had completely abandoned them and left alone, according to the court report. The high school student suffered the retinal detachment of the right eye, due to the trauma she suffered, and she had to undergo three eye surgeries in the following months and years. In recent days the Court of Florence published the sentence and the related reasons; this is because the insurance company, which in this case is Florentine and had requested and obtained the move of the trial from Siena to Florence, as ordered by the judge, will actually pay the girl, who is now 28 years old.

The facts

In the legal proceedings it emerged that 12 years ago some of the girl’s high school students and classmates had started throwing basketballs at each other, without starting a normal game, just for the fun of it, taking advantage of the teacher’s absence. who had left them completely alone and without supervision, and suddenly it had happened that one of the boys, without realizing the presence of his partner in his immediate vicinity, had thrown the ball so violently that it had hit the right side of the face of and in particular the right eye of the victim who was talking to some of her friends, not caring about what her companions were doing.

The girl was falling to the ground and in pain she burst into tears and at that point her classmates helped her and someone went to look for the teacher who didn’t even call 118 immediately, according to the testimonies in the trial documents, but would have notified her parents first. Upon her arrival at the hospital, the doctors had requested more in-depth tests from colleagues in the ophthalmology department of the Le Scotte hospital in Siena, where the following day she underwent emergency surgery for “retinal detachment in the right eye with multiple breaks” , which was followed by a long period of illness and hospitalization but with permanent after-effects. But in the following years, in fact, the girl had to undergo two more surgeries on her eyes to improve her situation. In the days following the incident, the family members had decided to sue the school, the professor and the ministry of education, for verification and compensation for all the damages suffered by their daughter, «for failure to supervise and control the conduct, including violent , held by his classmates.”

The sentence

For judge Liliana Anselmo of the Florentine Court there are no doubts about it responsibility of the teacher and therefore of the institute school and the ministry for the serious accident and for the serious events that occurred on 10 December 2012 in a high school in Siena. The sentence published in recent days also established that even if the teacher had been present in the gym, he would have been equally responsible for the incident for not having given the exact instructions to the students regarding the behavior to be followed, including, for example, to refrain from throwing basketballs recklessly in a dangerous manner and not related to sporting activities.

A medico-legal report quantified the exact amount of all the damages suffered by the girl, 135 thousand euros, to which the judge also added approximately 14 thousand euros in legal costs. The sentence is immediately enforceable and the former high school student, now 28, will have to be compensated 12 years after what happened to her during physical education class at school.
