This is what we read in a note released by the lawyer, Simona Figliuccifollowing the acquittal of his client, accused of sdeal of narcotic substanceswhose position was initially aggravated by the accusation of mafia association.
“Preliminarily against the order for the application of precautionary measures in prison, a request for review was proposed by the same lawyer at the Court of Reggio Calabria, which was accepted with the order, signed by the President Dr. Antonino Francesco Genovese, the exclusion in relation to the crime charged in chapter 29 of the aggravating circumstances referred to in art. 416 bis 1 cp, replacing the precautionary measure of custody in prison with that of House arrest in Rosarno, arranging the reinforcement of the electronic bracelet at the same time“, writes the lawyer.
“Cucinotta had been condemned by the Gup of Reggio Calabria in the person of Dr. Bellini for the crimes referred to in art. 74 Presidential Decree 309/90 and art. 73 Presidential Decree 309/90 to 5 years and 8 months of imprisonment, the Prevention Measure of Special Public Security Surveillance had been applied to the same for a duration of 3 years, redetermined as 2 years before the Court of Appeal of Reggio Calabria, Prevention Measures Section. Cucinotta was immediately granted, under house arrest weekly outings for primary life needs and attached work authorization at a restaurant business located outside the municipality of residence“, concludes the note.
