Medically assisted suicide. The government confirms the appeal against the Emilia Romagna Region

The Presidency of the Council of Ministers and the Ministry of Health have filed an appeal with the Emilia Romagna Regional Administrative Court against the Emilia Romagna Region to request the annulment of the council resolutions which implemented medically assisted suicide in the Region. The reasons highlight the absolute lack of power of the Viale Aldo Moro institution regarding the topic, and the contradictory and illogical nature of the reasons introduced in the guidelines sent to the healthcare companies.

18 APR – On 12 April, the Presidency of the Council of Ministers and the Ministry of Health filed an appeal with the Emilia Romagna Regional Administrative Court against the Emilia Romagna Region, and in particular against the health management for Personal Health, to request the annulment of the resolutions council that implemented medically assisted suicide in the Region.

The reasons, reported in over 20 pages of the document, highlight the absolute lack of power of the Viale Aldo Moro institution regarding the topic, and the contradictory and illogical nature of the reasons introduced in the guidelines sent to the healthcare companies for the management of the medically assisted suicide.

The regional councilor of Forza Italia, Valentina Castaldiniexpresses satisfaction: “I am very happy that the government, with this formal act, confirms and strengthens the work of these months, which led me to file a similar appeal last March. The executive considered that the path of the appeal that I opened up that it was the correct one and that there were all the necessary conditions to annul the resolutions, as I have always maintained”.

Last February, the regional council approved two resolutions for access at the end of life, and sent guidelines to healthcare companies for managing requests for medically assisted suicide. From the beginning, Castaldini had pointed the finger at the excess of power perpetrated by the Bonaccini junta, which in doing so effectively evaded the discussion (and vote) in the Legislative Assembly, to avoid splitting the Democratic Party group. Hence, councilor Castaldini’s appeal to the Administrative Court of Emilia Romagna: “We hope that everything has not already been decided, and that a voice will be given in a democratic manner, with a true and rigorous debate, both to those who are against and to those is in favour”, declared Castaldini.

And now, the route of appealing to the TAR has also been taken by the government. A united front against a completely questionable way of operating. “The satisfaction is amplified by the fact that the front of those who believe that the Region’s way of proceeding is legally questionable and politically incorrect is expanding and reaching the highest government institution. This strengthens a battle that is not only legal, but also of defense of fundamental ethical and democratic principles”, concludes Castaldini.
