Frost. For the criminal panel of the court, chaired by judge Miriam D’Amore (alongside Eva Nicastro and Martina Scuderoni), there were no possible anomalies to be attributed to the defendants. The municipal employee Luigi Buttiglieri and Rocco D’Assenza, at the time of the events responsible for the local Blue Line company, which managed the paid parking service, were acquitted. According to the prosecutor’s office, in the awarding of the service to the company, dating back to 2017, the hand was forced, first of all during the evaluation phase of the offers. According to the prosecution, there were alleged violations of the relevant legislation, only to favor it. The prosecutor concluded with a request for a sentence of two years each for both. The panel instead ordered acquittal, “because the fact does not constitute a crime”, compared to the position of Buttiglieri, who was rup in that procedure, and “because the fact does not exist” for D’Assenza. The defense, supported by the lawyers Giuseppe Condorelli and Filippo Spina, also in the final discussion reiterated that there were no omissions that were almost in favor of Blue Line. They did not overlook the fact that a special internal commission had been set up to evaluate the offers. According to this reconstruction, the conditions for the violation of the freedom of the auctions, contested in the criminal proceedings, cannot be identified.
