It is approaching due date of the balance and the 1st deposit of the IRPEF substitute tax. This year, for taxpayers under the regime flat rate and minimums, there is an extra month of time compared to the generality of VAT numbers: the deadline has been the subject of extension to 31 July 2024.

The tax, as usual, must be paid in the amount of 5 percent for the first 5 years of relevance and in compliance with particular legal requirements and the 15 percent for the following years.

The. must be respected maximum revenue or compensation limit of 85,000 euros.

The point on rules, terms and calculation in view of payment via F24 form of the second balance and the 1st 2024 advance payment of the substitute tax due by VAT holders under the minimum regime and by taxpayers under the flat rate regime.

Minimum and flat-rate substitute tax deadline, balance and advance payment 2024: how to calculate the tax to be paid

VAT holders who apply the flat rate regime are required to pay asubstitute tax of 15 percentor of 5 percent for the first 5 years of activity, while those who apply the minimum regime pay a substitute tax of 5 percent.

Generally speaking, payments of the substitute tax follow the deadlines in the IRPEF calendar. This year, however, for the payment of the 2023 balance and the 2024 advance, the extension foreseen for the adoption of the biennial preventive agreement must be taken into account.

Article 37 of the legislative decree of 12 February 2024 number 13 provides, for ISAs and taxpayers who apply the flat rate regime, the postponement of the canonical deadline of 30 June until July 31st.

The mode calculation remain the same:

  • historical methodthe tax is calculated using the substitute tax paid in the previous year as a reference;
  • forecasting method, the calculation of advance payments is carried out on the basis of an income forecast for the current year. If the taxpayer expects a lower income than in the previous tax period, the advance payments are paid in a lower amount.

Minimum and flat rates: the tax codes to be included in the F24 form

To pay the substitute tax, form F24 must be used. They must be entered reference tax codes for the balance and the 2024 advance.

Minimum substitute tax: the deadline of the 2023 balance and the 2024 advance

The minimum regime was repealed by Budget Law 2016but remains in effect up to the age of 35 of the taxpayer.

Who applied the minimum regime in the previous year and continues to do so must pay the balance and the advance payment of the 5 percent substitute tax within deadline July 31st.

The following must be respected rules:

  • for an amount less than 51.65 euros the deposit is not due;
  • for an amount between 51.65 and 257.52 euros peradvance payment must be paid in a single payment by 30 November 2024;
  • for a amount exceeding 257.52 euros payment must be made in two instalments:
    • first deposit by June 30th, this year by July 31st;
    • second deposit by November 30, 2024.

There remains the possibility of paying within 30 days with an increase of 0.40 percent, therefore by the end of August.

The situation of the taxpayers who made the payments must also be considered a transition from one regime to another.

This situation requires special attention. Specifically, there are two cases in question:

  • taxpayers in the minimum regime in 2023 who switched to the ordinary regime in 2024: they must pay the 2024 advance of the substitute tax (tax code 1793) and must indicate the amount paid in the RN part of the form. INCOME 2024 PF;
  • taxpayers in the minimum regime in 2023 who switched to the flat rate regime in 2024: VAT holders who applied the minimum regime in 2023, and switched to the flat-rate regime in 2024, must pay the 2022 advance of the minimum substitute tax – tax code 1793 – and must indicate the amount paid in the LM framework of the 2024 Income model.

Flat-rate regime substitute tax: the deadline of the 2023 balance and the 2024 advance

THE holders of a flat-rate VAT number in 2023 and 2024 must apply the rules calculation and payment of the 15 percent substitute tax provided for IRPEF purposes.

These rules are the same as those reported for those falling within the minimum regime.

Taxpayers who, however, switched to the ordinary regime in 2024 must pay the substitute tax using the tax code 1790 and indicating the amount paid in RN framework of the 2024 Income model.

Those who initiated an activity this year they do not have to pay the balance and the tax advance because the calculation basis is missing.
