The second edition of Arte e Fisco presents itself as a transversal journey through the legal, fiscal and wealth planning aspects of the art world, with particular focus on the impact of new technologies.

Starting from the importance of legal protection of works of artthe effects of which have repercussions on taxation of capital gains, the text analyses, with the help of doctrine and jurisprudence – up to the very recent provisions of the Supreme Court – the figures of the collector, the art dealer and the “collector speculator”. The purchase of the work of art is examined from a tax point of view, in self-employment income It is in the business incomewith the aim of highlighting the salient features and related effects.

The treatment of tax aspects addresses not only the impact ofVAT in the circulation of works of art both in Italy and in EU and non-EU countries, but also the imposition of NFTs and crypto art, with the related implications on RW framework.

Ample space is also left to the possible solution of paying taxes through the direct transfer of works of art pursuant to art. 28-bis of Presidential Decree 602/1973.

This second edition includes an entirely new section relating to aspects of wealth planning (intended as estate planning) of works of art, with the aim of supporting artists, collectors, but also family offices and trustees for the effective management and holding (through trust structures) of an art collection.

The generational transition requires adequate planning, in order to combine the needs of family governance with the management of the collection, always keeping in mind the fiscal impact of the transfer of ownership. The latter could lead to the need for immediate liquidity for the heirs, which can be met by taking out specific life policies aimed at creating a reserve of (rapidly available) funds.
