«Ilaria can return to Italy». Words of joy and relief were spoken by Mauro Straini, lawyer of the new European MP who had been detained in Hungary for 15 months. A few days after her election among the ranks of Avs, she was also released from home detention and yesterday morning the judicial police of Budapest took away her electronic bracelet. The words of her lawyer preceded by a few hours the confirmation that came from the court in the Hungarian capital. «The trial in Hungary against Ilaria Salis is suspended» clarified the Hungarian judge Jozsef Sós in the provision with which he ordered the release of the 39-year-old today. The ordinance in Hungarian in about ten pages is based on the “communication” sent in recent days by the Ministry of Foreign Affairs with the attached list of the 76 parliamentarians elected in Brussels and Strasbourg for Italy. On the basis of this, the magistrate established that Salis must enjoy parliamentary immunity “immediately”, basing the decision on a sentence of the European Court of Justice which established that the status of parliamentarians is achieved from the moment of election and not to the proclamation and installation. Judge Sòs therefore ordered the release from prison and the suspension of the criminal proceedings, for which Salis risks a 25-year sentence. If necessary, it will be up to the Hungarian judicial authority to ask the new European Parliament to waive immunity. “Finally! We are happy with the news that comes from Budapest, MEP Ilaria Salis can now return to Italy and will be able to carry out her new role for which hundreds of thousands of voters have indicated her. On May 15th the Hungarian court of second instance surprisingly accepted the defense’s appeal which had already been rejected under house arrest on March 28th. The Lombard activist is accused of aggravated injuries towards two neo-Nazis for the clashes of 11 February 2023 on the occasion of the “Day of Honour”. The accusation is in fact of “potentially lethal” injuries, despite the victims’ wounds being considered healable in 5 and 8 days.
