MAGLIE – The Council of State, V section (President De Nictolis, Rapporteur Councilor Urso) accepted the thesis put forward by the Municipality of Maglie, deeming correct the calculations that the Administration proposed to the Mengoli company, which manages energy efficiency.
While the TAR had considered a greater sum due for the revaluation, equal to over two hundred thousand euros, the highest body of Administrative Justice instead deemed applicable – in accordance with the municipal defense of Maglie – the formula of the contract, which provided for an exemption and a different starting index to determine the sums potentially due to the contractor.
The Municipality of Maglie made use of lawyers in the dispute Luciano Ancora and Francesco G. Romano.
The Mayor of Maglie, Dr. Ernesto Tomaexpresses great satisfaction: “We have always considered the actions of our offices to be correct, validated in fact by a CTU and an ad acta Commissioner: in addition to the sum already saved, thanks to the decision of the Council of State, the calculation method, endorsed from the last sentence, will produce a very evident saving also for the years following those considered so far.
The time has therefore come to take stock and make definitive choices, imagining a different and more modern, efficient service, capable of producing considerable cost savings.”
