Accident at work in Chiuro, the defendants of the Serpentino Graniti company acquitted

Laura Lenatti, in her capacity as legal representative of Serpentino Graniti Srl, and her son Pietro Cabello, director of the company, were acquitted because the fact does not exist, both defended by the lawyers Monica Cabello and Stefano Di Pasquale, at trial for events which occurred in Closed on 30 April 2020.

An employee of the company of Indian origin, Avtar Singh, 54 years old, assisted in the trial by the lawyer Manuela Mauro, was seriously injured that day while moving a block of serpentine, causing serious injuries (almost total amputation of the right leg) with a prognosis greater than 120 days of illness.

The crime charged against the defendants was that of serious negligent injury for having caused the accident due to violation of regulations for the prevention of accidents at work (failure to train regarding specific risks also with respect to the linguistic knowledge of the injured person). During the discussion, the prosecutor, Dr. Chiara Costagliola, asked for the conviction of the accused.

At the end of a long and in-depth investigation (6 hearings), the judge of the Court of Sondrio, Dr. Valentina Rattazzo, fully acquitted the defendants because the fact does not exist. During the trial, numerous witnesses were heard, including regarding the injured person’s knowledge of the Italian language, as well as technical consultants regarding the reconstruction of the dynamics of the accident. The activity carried out in the trial made it possible to demonstrate that no criminal liability could be attributed to the defendants.
