ON THE DANGER OF FOREST FIRES FOR THE YEAR 2024
Considering that with the summer season the risk deriving from possible fires of stubble, weeds and shrubs of all kinds increases, the municipal administration has decided to enact suitable measures to prevent and avoid the risks of fires as well as to protect, at the same time, public and private safety.
Therefore, the union ordinance, based on the reasons set out in the regional DPGR, in point II, prohibits anyone from:
· light fires of all kinds;
· explode mines or use explosives;
· use flame or electric devices to cut metals;
· use engines (except for those used to carry out authorized forestry work and not in conflict with the PPMPF and other regulations in force), stoves or incinerators that produce sparks or embers;
· keep furnaces, wood-fired ovens and uncontrolled public and private landfills in operation;
· smoking, throwing matches, cigars or lit cigarettes and carrying out any other operation that could create an immediate or intermediate risk of fire;
· carry out pyrotechnic activities, light fireworks, launch rockets of any type and/or paper hot air balloons, better known as flying lanterns equipped with open flames, as well as other pyrotechnic articles;
· transit and/or park vehicles on unpaved roads within wooded areas;
· transit with motorized vehicles outside state, provincial, municipal, private and local roads, burdened by public transit services, with the exception of service vehicles and agro-forestry-pastoral activities in compliance with the rules and regulations in force;
· abandon waste in the woods and in illegal landfills.
The same provision orders the following behaviors and provisions:
· the owners, tenants and managers of cereal cultivation fields, at the end of the reaping-threshing operations, must promptly and simultaneously create a precesa or protective strip free of any residual vegetation around the perimeter and inside the cultivated surface, for a width and continuous and constant of at least fifteen meters, or in any case, such as to ensure that the fire does not spread to the surrounding or/and bordering areas. The protective band, regardless of the harvesting and threshing operations, must in any case be created by 15 June;
· in order to prevent the occurrence of damage to public and private property and to avoid causing alarms, it is prohibited to burn stubble and straw and vegetation present at the end of cereal and fodder crops as well as agricultural and forestry plant residues on all the municipal territory in the period of serious fire danger
· the owners, tenants and tenants, for any reason, of uncultivated land in a state of abandonment or at rest, or of tree crops insistent in the municipal territory, for the entire period of validity of the state of serious danger, are absolutely prohibited from burning spontaneous vegetation, as well as the obligation to create, by and no later than 14 June, protective or closed strips of no less than fifteen meters in width along the entire perimeter of one’s land, free of vegetation residues, so as to prevent a any fire, crossing the bottom, could spread to the surrounding and/or neighboring areas;
· the owners, tenants and tenants, in any capacity, of olive groves and vineyards, by 14 June and for the entire period of validity of the state of serious danger, must ensure the elimination of brambles and weeds as well as residues crops that can be or become the cause of starting and/or spreading fires;
· the owners and tenants and/or managers in any capacity of rustic properties, lands and areas of any nature and their appurtenances, uncultivated and/or abandoned, adjacent to the railway headquarters and falling within the municipal territory, must carry out by 14 June, the necessary checks and the elimination of danger factors as provided by the combined articles. 52, 55 and 56 of Presidential Decree 753 of 11/07/1980 and LR 12/12/2016 n. 38, each for the parcel under their jurisdiction;
· owners, tenants, tenants, public and private bodies in charge of management, maintenance and conservation of the forests are obliged to carry out, by 14 June, the restoration and cleaning, including mechanical, of the firebreak avenues, where provided, and in particular along the border with forest tracks, roads, motorways, railways, arable land, pastures, uncultivated and bushy land;
· by 14 June, and for the entire period of validity of the state of serious danger, the owners, tenants and tenants in any capacity of wooded areas bordering other crops of any type as well as roads, motorways and railways, inhabited centers, homes isolated and residential, tourist or productive or other types of settlements, must, at their own expense, constantly keep reserved a protective strip on their property, at least five meters wide, free from weeds, brambles and necromass species, also affecting any scavenging and/or pruning no more than the lower third of the height of the plants present along the perimeter of the forest; the aforementioned prevention activities are not subject to prior authorization procedures strictly connected to the conservation of the forest heritage;
· the owners, tenants and tenants, in any capacity, of grazing areas, have the obligation to create, by 14 June, a perimeter protection strip free of vegetation of at least five meters, and in any case, such as to ensure that the fire does not spread to surrounding and/or neighboring areas;
· the owners, managers and managers of campsites, tourist villages, residential centres, hotels and accommodation facilities as well as anthropic structures (including homes and/or isolated agricultural companies) located in urban or rural areas exposed to contact with possible fire fronts , are required by 14 June to create a protection strip at least fifteen meters wide, free of dry grass, shrubs, vegetation residues and any other type of easily flammable material, along the perimeter of their settlement. They will have to adopt suitable fire defense systems in compliance with the regulations in force regarding safety and protection of public safety, also through mobile equipment equipped with tanks and motor pumps, appropriately equipped on suitable vehicles, for any extinguishing interventions on fires that may arise. even on the edges of the aforementioned settlements. They must also prepare special, clearly visible signs indicating the escape routes and assembly points which must be kept constantly free and accessible;
· along the perimeter of the areas in contact with wooded, bushy, tree-lined and pasture areas on which there are powder magazines and deposits of materials with a high explosive and/or flammable risk, all precautionary measures must be adopted by 14 June, including the creation of special protection strips at least fifteen meters wide, free of vegetation residues and any other type of easily flammable material, in order to prevent the ignition and spread of any fires;
· anyone who spots a fire that affects or threatens wooded, bushy, tree-lined and pasture areas, including any man-made structures and infrastructures located within the aforementioned areas, is obliged to immediately notify the competent local authorities, reporting any useful territorial element for the correct location of the event;
· in the event of the occurrence of forest fires – unless there is a justified reason – anyone is obliged, pursuant to art.33 of RD3267 of 12/30/1923, to provide their help or service to the person in charge of the extinguishing operations, or to the authority defendant;
· the Railway Management Company – RFI, ANAS, the Aqueduct Pugliese, the Autostrade Company, the Metropolitan City of Bari, the Reclamation Consortia, the ASI Consortium, by 14 June 2024 and in any case for the entire period of validity of the state of serious danger, along the road axes of respective competence (including sheep tracks) in the municipal territory with particular regard to the sections crossing wooded, bushy, tree-lined and grazing areas in the territory or close to them, must ensure the cleaning of the docks, ditches and slopes, by removing dry grass, plant residues, brambles, necromass, waste and any other flammable material in order to create, in fact, suitable protection bands in order to prevent any fires from spread to surrounding and/or neighboring areas. The managers of the indicated roads and railways are also required to carry out periodic maintenance on the tree vegetation by pruning, where necessary, the lateral branches and scaffolding, where this tends to close the roadway, in order to allow the transit of emergency vehicles. fire prevention.
The ordinance also provides that the Carabinieri Forestry, Environmental and Agri-Food Protection Unit Command – Bari Forestry Carabinieri Group and the other police bodies, including the Environmental Surveillance Unit of the Surveillance Section of the Puglia Region, the Metropolitan Police Service of the City Bari Metro, the Local Police of Bari, the agents and judicial police officers, as well as all other territorial bodies responsible by law, ensure strict compliance with the rules set out in this Ordinance.
