Father shot dead, son sentenced to 3 years

The judges of the Court of Assizes of Caltanissetta sentenced Giuseppe Spataro, 41, to 3 years of imprisonment for the death of his father, Salvatore Spataro, who died on 7 October 2017 in the family home in Barrafranca with a rifle shot.

The arrest and the Prosecutor’s thesis

In January 2018, the arrest of the accused was ordered, accused of murder and the Prosecutor’s Office, during his indictment, as reported by the newspaper La Sicilia, had requested a life sentence but the judges reclassified the crime in manslaughter, supporting the theory of tragedy.

According to what was presented by the magistrates, the man, on that dramatic day, which took place in the family home, took a Benelli semi-automatic rifle, regularly detained, and shot his 68-year-old father, mortally wounded in the chest, and then attempted suicide, firing two shots in the abdomen and jaw.

The new reconstruction

But during the trial another reconstruction emerged, the one which then convinced the judges to reduce the defendant’s responsibilities: according to this last dynamic, Giuseppe Spataro would have tried to end it and after hearing the shot the father would have ran towards his son and in an attempt to take the weapon away from him a shot was fired which caused his death.

At that point, Giuseppe Spataro would have attempted, for the second time, to commit suicide but in this case too he suffered a serious injury. One of the key witnesses is the mother of the accused, who called for help after that tragedy.

The ticket

Giuseppe Spataro was taken to the Caltanissetta hospital to undergo surgery and in his trousers the Carabinieri, in charge of the investigation, found a note in the defendant’s trousers in which it was written “It’s all my fault maybe I would have listened to my father.”
