Netco dossier, first tug-of-war in court: the judge takes her time

It was staged at the Court of Milan first hearing on the Netco dossier following the appeal presented by Vivendi on the sale of the network to KKR. A “flash” hearing considering the requests of the French on which judge Daniela Marconi reserves the right to decide. The main shareholder’s lawyers have requested additional documentation from TIM, KKR and the Ministry of Economy. But according to Tim’s lawyers, Vivendi already has all the necessary information on the operation. Marconi reserved the right to decide on the issue in order to then proceed on the merits. It may take a few days to untie the knot.

Vivendi, new chapter without Tim in 2025

At the end of April, during the presentation of Vivendi’s quarterly results, CEO De Puyfontaine announced that a new chapter will be written in 2025 “but without Tim”. The manager reiterated the disagreement on the economic conditions of the sale of the network: “They are unacceptable as regards the process”, referring to the failure to convene an ad hoc meeting. “Our priority is to ensure the defense of our rights as major shareholders of the company.”

Labriola focuses on long-lasting growth

“In the next three years we will work to guarantee lasting growth of the Group in the interest of all stakeholders and with the aim of enhancing its strengths”, said CEO Pietro Labriola on the occasion of the green light given by the Assembly to the new TIM board of directors who confirmed the manager at the helm of the telco and appointed Alberta Figari in the role of president.

The Netco dossier on the table of the EU Commission

In recent days, Fastweb, Iliad and Vodafone were summoned to Brussels: glo Olo ask that wholesale access to fiber be guaranteed in passive mode which involves the rental of dark fiber only for the last stretch of infrastructure (subloop) until homes, compared to an initial hypothesis which envisaged renting the entire stretch of network – between the power plant and homes – which would have entailed significant extra costs for competitors. KKR has already anticipated the list of remedies to the European Commission and the final offer should be presented in the next few days. At that point the Antitrust will have to decide.
