Rome, 10 May 2024 – There is important news in the field of medically assisted procreation (pma). Consent cannot be revoked and the woman will be able to request the implantation of the embryo even in the event of the partner’s death or termination of the relationship. The new guidelines, published in the Official Journal, are an update of those of 2015. The document is also the result of the work of the technical table on MAP established in 2023. “For applicants – we read in the Guidelines – when accessing the techniques of medically assisted procreation, the legal consequences referred to in the art. must be explained clearly and in writing. 8 and art. 9 of law no. 40/2004. It must be represented in the same way that, afterwards assisted fertilization of the eggconsent to MAP cannot be revoked and the woman can request the implantation of the embryo even if the partner has died (Cass., 15 May 2019, n. 13000) or their relationship has ceased (Constitutional Court, n. 161/2023)”.

Medically assisted procreation (Pma), commonly called “artificial insemination” is the set of techniques used to help conception in all couplesin cases where spontaneous conception is impossible or extremely remote and in cases where others pharmacological and/or surgical interventions are inadequate. Pma uses different types of techniques that involve the manipulation of oocytes, sperm or embryos as part of a treatment aimed at achieving a pregnancy.
