TRIESTE The Trieste Public Prosecutor’s Office has served a notice of warrant for road homicide to the motorist involved in the accident on 2 January in Via Locchi, in which the eighty-one-year-old scooter rider Livio Toffolini was the worst.
At first, the accident seemed to have resulted in simple injuries to the elderly man. Instead, Toffolini died after a long stay in Cattinara hospital. His death occurred a few days ago and his family had already set the funeral for April 29th. Then the Prosecutor’s Office intervened, obliged to shed light on the causes of death and to clarify whether there is a causal link between the accident and the death, or whether some other event subsequently occurred in the 81-year-old’s health.
Tomorrow the deputy prosecutor Matteo Tripani, in charge of the proceedings, «will instruct the medical examiner to carry out the autopsy – confirms the chief prosecutor Antonio De Nicolo – who could carry out the exam on the same day or, at the latest, on Friday. By the weekend it is reasonable to think that the approval for the burial will be given.”
The autopsy must be carried out in a guaranteed form, therefore with a notice already notified to all parties: to the person who is under investigation for road homicide, together with the guarantee information, with an invitation to appoint a defender and a consultant to assist in the operations experts, and to the injured parties, or to Toffolini’s family members who in turn can appoint an expert. The autopsy report will be filed after about sixty days, but in the meantime the 81-year-old’s family will be given the go-ahead to proceed with the burial.
After the accident, the local police report had already assumed the responsibility of the motorist. «While awaiting the outcome of the autopsy – explains De Nicolo – we will evaluate whether it will be necessary to carry out further investigations on the dynamics of the accident or whether the picture is already absolutely clear». —
